LAZ Backs Judges Mutuna, Kajimanga Challenge of Tribunal

Lusaka-high-court-big-pixThe Law Association of Zambia (LAZ) has observed that Justices Charles Kajimanga and Nigel Mutuna are within their rights to challenge the constitutionality of the Tribunal as contained in the court action.

In application for judicial review filed in the Lusaka High Court, judges Kajimanga and Mutuna have contended that the tribunal that has been set to probe their alleged professional misconduct, has no legal framework consistent with the constitutional rights and that it has failed to give the applicants adequate notice of its proceeding to give them time to prepare and exercise their constitutional rights.

In statement released to Qfm by LAZ honorary secretary Linda Kasonde, the association’s Council has however declined to comment on the merits and demerits of such actions by the two judges.

The LAZ Council has further observed that the State as represented by the Attorney General is equally entitled to oppose the application if it wishes to.

The LAZ Council has also advised members of the public not to speculate on the matter but to allow the courts of law to handle the matter professionally.
