Attorney-General Mumba Malila says the State will file an application before Ndola High Court Judge Mwiinde Siavwapa asking him to discharge his ruling granting two High Court judges leave to challenge the legality of the tribunal.
The Lovemore Chikopa-chaired tribunal was constituted to prove the judges’ alleged professional misconduct.
Justice Siavwapa on Wednesday granted Justices Nigel Mutuna and Charles Kajimanga an ex-parte application to start judicial review.
The review would operate as a stay of the tribunal proceedings which were scheduled to start on June 18, this year.
But Malila said in an interview yesterday that the recent ruling of the Supreme Court was clear in that the proceedings of the tribunal could not be arrested as they were investigative in nature.
He said the Supreme Court had ruled that President Michael Sata was within his powers to suspend the judges and subsequently set up a tribunal to probe them.
Malila said the essence of the application would be to ask Mr Justice Siavwapa to interpret the meaning of the Supreme Court judgment delivered by acting Chief Justice Lombe Chibesakunda recently.
The application would also ask the judge to discharge his ruling and allow the tribunal sittings to go ahead.
He said his office was already preparing documentation which would be filed before court by Tuesday next week.
Meanwhile, Justice Minister Wynter Kabimba has urged workers in his ministry to be efficient in their execution of duties and provide quality services.
Kabimba advised the employees to be honest, disciplined and to change their work culture as the ministry was important in offering legal advice to the government.
He said yesterday during the Labour Day awards presentation ceremony for employees in Lusaka that the ministry would not hesitate to punish indisciplined workers.
