Quash Siliya Ruling, Defence Asks Supreme Court

Dora Siliya addresses journalists at Lusaka Magistrates CourtLawyers representing Dora Siliya and two others have asked the Supreme Court to quash the stay of execution granted by acting deputy Chief Justice Florence Mumba.

The lawyers argued that the state had no right to appeal the decision on behalf of the Electoral Commission of Zambia which was an independent body with its own independent legal person.

They argued that the ECZ had not appealed the decision and wondered how the decision would affect the state.

The lawyers argued that the state was not affected by the decision but went ahead to seek a stay after High Court Judge Mungeni Mulenga refused to grant the stay.

Petauke Central aspiring candidate Siliya and her Malambo and Mulobezi counterparts Maxwell Mwale and Hastings Sililo are challenging the ECZ’s decision to bar them from re-contesting their positions after they were nullified by the courts of law.

The High Court had given them a go ahead to file their nominations after a successful court action but the state through the Attorney General appealed the decision.

Justice Minister Wynter Kabimba had applied to join the proceedings but his application was thrown out.
