Supreme Court Reserves Kakoma, Kazonga Ruling

lusaka-high-courtThe Supreme Court has reserved ruling in the case in which UPND member Charles Kakoma and MMD member Eustackio Kazonga are challenging their ineligibility to re-contest their seats after the Supreme Court nullified them.

Kazonga, whose Vubwi seat and Kakoma of Zambezi West, contend that they have the right to re-contest their seats a move opposed by the ruling Patriotic Front who are believed to have laid a scheme to eliminate vocal opposition lawmakers through a user friendly court system overseen by the controversially appointed acting Chief Justice Lombe Chibesakunda.

A seven member bench led by Marvin Mwanamwambwa reserved ruling on the matter to a later date.

Chief Justice Chibesakunda was forced to recuse herself after it emerged that lawyers for the State Bonaventure Mutale and Abraham Mwansa are also representing her in a case where her appointment to the position of Chief Justice has been challenged in court by the Law Association of Zambia.

Kakoma and Kazonga are asking the court to rule in their favour to allow them re-contest their seats.

The by-elections were initially set for January 7 but have since been frozen out due to the court challenge.
