The Supreme Court has ordered a retrial in the case in which Post Newspapers editor Fred M’membe and his business associates were ordered to repay the K14 billion debt they owe to the Development Bank of Zambia.
Judge Munyinda Wanki said Judge Nigel Mutuna had no jurisdiction to preside over the matter after it was transferred to him from Judge Albert Wood.
Wanki said the case was irregularly awarded to Mutuna and amounted to a breach in procedure after Wood declared interest in the matter.
M’membe and his associates have since engineered a tribunal against Mutuna and two others for alleged misconduct and the ruling by Wanki may be prejudicial to the outcome of the tribunal.
