The Lusaka High Court has granted former Tourism Minister William Harrington the right to commence judicial review of the judge Rhoyda Kaoma tribunal findings against sacked Tourism Minister Sylvia Masebo.
High Court judge Gertrude Chawatama granted Harrington the right to proceed after he sought the review of the findings of the tribunal that said although Masebo had committed transgressions they did not amount to misconduct.
Harrington wants the High Court to interpret the parliamentary and ministerial code of conduct act on what constitutes pecuniary advantage.
Meanwhile, the judge has recused herself from hearing the case saying she had sat on another tribunal where similar matters arose.
The case will be allocated to another judge in due course.
