Magistrate Sends M’membe Away Head Down on Rupiah Defamation

Magistrate's CourtDirector of Public Prosecutions Mutembo Nchito will have to work harder to save his friend Post Newspapers Editor Fred M’membe with Lusaka Magistrate Mwaka Mikalile referring to the High Court the matter in which Nchito is pleading to prosecute his business associate M’membe for contempt of court.

Former President Rupiah Banda has sued M’membe for contempt of court for presumptuous editorials he ran in his paper alleging that Banda is corrupt.

Nchito had suspiciously sought to take over the case from Banda’s lawyers saying he had the right to prosecute the case against M’membe prompting the former Head of State to seek the court’s intervention.

M’membe who has long desired a stronger control on the judiciary appeared in person looking in high spirits that he was set for one of his routine victories but walked away with his head drooped as the subordinate court referred the matter to the High Court noting that Nchito could not prosecute M’membe fairly as they were business associates and personal friends.

Nchito and M’membe collectively owe the Development Bank of Zambia K14 billion that they borrowed under the Zambian Airways that they ran down.

Banda has already succeeded in another case to prove that Nchito is not the right person to prosecute him as he is blinded by hatred for him and also desire to protect his cabal of friends.
