MMD president Dr Nevers Mumba has argued that expelled party national secretary Major Richard Kachingwe has no right to petition him because he is no longer a member of the party after being expelled on Saturday.
Dr Mumba told Lusaka High Court judge Jane Kabuka yesterday through his lawyers that he should be given time to raise more preliminary issues before conducting the inter-party hearing over the application for an injunction.
Following this application, the matter could not proceed and it will be scheduled for another date.
Maj Kachingwe has filed an injunction to restrain Dr Mumba from performing his duties after he was hounded out of the party secretariat on Saturday for creating confusion in MMD as a PF sponsored mercenary.
He has argued that Dr Mumba is still registered as a Republican Party at the Registrar of Societies and that he does not qualify to be MMD president.
Sources have disclosed that Maj Kachingwe is a sponsored gun by President Sata in the ruling party’s agenda to weaken the opposition.
