The Lusaka Magistrate Court has put to shame police abuse of the Public Order Act by acquitting five UPND cadres who were charged with conduct likely to cause breach of peace.
Magistrate Solomon Ng’ambi said the police acted in a manner that frustrated the cadres.
The five Aaron Sililo Pumulo, Patrick Ntalasha, Joseph Mazonda, Winstone Chisuntu and Lemmy were on June 6, 2012 arrested during a demonstration against Director of Public Prosecutions Mutembo Nchito.
The police on instruction from then Lusaka Division Commander Charity Katanga brutally broke up the demonstration clobbering the youths.
In acquitting the five, Magistrate Ng’ambi said that the law is silent on what happens when people are denied a permit under the Public Order Act.
