A 15-year-old girl this afternoon (10/10/14) testified in the Kitwe magistrate court how she was allegedly defiled by her uncle in 2012.
This in a case Former Kitwe Mayor Divo Katete is charged for defiling a child below the age of 15.
Particulars of the offence are that Divo Brandon Katete 41, a businessman of House Number 5 16th Street Nkana East in Kitwe district of the Copperbelt Province on dates unknown but in the month of December, 2012 in Kitwe district allegedly had unlawful carnal knowledge of a girl below the age of 16.
Katete, who is also loosing MMD Nkana constituency candidate, is alleged to have defiled a girl below the age of 16 contrary to Section 138 sub-section 1 of the Penal Code chapter 87 as amended by Act Number 15 of 2015 and Act Number 2 of 2011 of the laws of Zambia.
When the matter came up for trial, the juvenile told the court that she was on several occasions allegedly defiled by her uncle who she visited for a holiday in Kitwe District from Mufulira in December 2012.
Narrating the ordeal to a fully pact court the juvenile said on unknown dates but in December 2012 on the fateful day around 24 hours, the accused did enter the room she was sleeping in and forced himself on her.
She told Principle Resident Magistrate IkechuKwo Iduma that on the fateful day the accused entered her room whilst putting on a tower and forced himself on her.
The juvenile explained that she failed to shout for help because she felt dizzy and weak at the same time.
“He came around 24hours in our room whilst I was sleeping; he was putting on a towel and came to my bed then started touching my private parts and my breasts, when I tried to push him, he told me to stop acting like a kid. I failed to shout because I was not feeling well, I felt weak and dizzy it was at this point that he lifted up my skirt and removed my pant then started having sex with me” the Grade 8 pupil told the court.
“He had sex with me for about ten times in the same month I was at his home for a holiday and in most cases my auntie was around” the court heard
Meanwhile, The Mother to the Juvenile Annie Nampungwe, who is the second witness, told the court that she only knew of her daughter being defiled when she received a message through the phone from her daughter on 14th September 2014.
“She called me then we talked after she hanged up the phone, she wrote me a message informing me that she was defiled by her uncle (Divo Katete), and then I called her back that’s when she explained everything to me” Ms Nampungwe testified before the court.
Ms Nampungwe told the magistrate court that she then took her daughter to Ronald Ross Hospital in Mufulira where she was issued with a medical report and later reported the matter at the Mufulira Central Police.
After a lengthy trail state prosecutor Friday Siame, applied that the matter be adjourned to a later date a move the two defence lawyers did not object to.
Kitwe Magistrate Court Principal Resident Magistrate Ikechukwu Iduma ordered that the accused appear for mention on the 3rd of October 2014 and his bail has since been extended to that date.
The Principle Resident Magistrate later adjourned the matter to 17th November, 2014 for continued trial.
Divo Katete was arrested on the 23rd of September, 2014 was later released on a 15, 000 Cash Bail with two working sureties.
