Former Kitwe Mayor Divo Brandon Katete has denied defiling a 16-year-old girl he is alleged to have defiled in December 2012.
After being put on his defence last month, the accused had the wife to defend him in the defilement case before Kitwe Principle Resident Magistrate Ikechukwu Iduma.
Particulars of the offence are that Divo Brandon Katete, 41, a businessman of House Number 5, 16th Street Nkana East in Kitwe district of the Copperbelt Province on dates unknown but in the month of December 2012 allegedly had unlawful carnal knowledge of a girl below the age of 16 contrary to Section 138(1) of the Penal Code chapter 87 as amended by Act Number 15 of 2005 and Act Number 2 of 2011 of the laws of Zambia.
In Defence the accused denied having carnal knowledge of the girl saying he was a married person and there was no reason for him to defile his brother’s daughter.
“It’s not possible for me to leave my bedroom and my wife to go in the young girl’s bedroom. I have never thought of such a thing because that girl is more like my daughter,” Katete told the Court.
And testifying before the court, Sylvia Katete the wife of the accused, told the court that her husband always spends his nights in the bedroom and she does not remember his husband leaving the bedroom in the night.
She said the accused sexually satisfies her and she sees no reason why the girl claims that she was defiled by her husband.
The 37-year-old teacher, a Degree holder in psychology, told the court that she was shocked when she heard that her husband had been summoned to the police over a defilement case.
Kitwe Principle Resident Magistrate Ikechukwu Iduma has since set 6th February, 2015 as the date for continued defence and the accused’s bail has been extended.
