The Foundation for Democratic Process (FODEP) has questioned the legality of summoning former Republican President Rupiah Banda by the Anti Corruption Commission (ACC) for alleged corrupt practices should.
FODEP Executive Director MacDonald Chipenzi said the matter needed to be handled with caution and within the confines of the law.
“The investigative wings should realize that the former President enjoys immunity from prosecution and therefore his case must be handled with caution,” Chipenzi said.
He said his organization supports any efforts aimed at fighting corruption but that there was need to respect the rule of law.
“There should be no sacred cows in the fight against corruption and that the crusade should be seen to yield positive results, but that means the rule of law needs to be respected.
According to a summon dated February 4, 2013 signed by Anti-Corruption Commission Director General Rosewin Wandi, Mr. Banda is expected to appear at the Drug Enforcement Commission head office in Lusaka this morning.
But the former President has indicated in writing to the ACC Director General that he would not avail himself for questioning today.
