LCC to Bury 23 Unclaimed Bodies

A total of 23 unclaimed bodies will in the next 14 days be buried at Chingwere Cemetery by the Lusaka City Council (LCC).

LCC Public Relations Manager George Sichimba has stated that this follows a request received from the University Teaching Hospital (UTH) for Council to bury the 23 unclaimed bodies.

Sichimba stated that according to a letter from UTH, the 23 unclaimed bodies have been laying in the mortuary for some time now and were giving rise to an unpleasant mortuary environment contrary to the Public Health Act Cap 295 of the Laws of Zambia.

He added that the bodies have also caused congestion in the mortuary hence the need to bury them.

Sichimba has disclosed that in accordance with the provisions of Section 61, Paragraph 41 of the Second Schedule of the Local Government Act Cap 281 of  Laws of Zambia, LCC has caused a public notice in the press about its intention to bury the bodies.

He stated that the 14 days according to the law has been assigned in the notice for members of the general public to claim/identify any of the bodies and conduct burial in which at the expiry of the assigned period, all the bodies that will not  be claimed shall be buried by the  local authority.

This will be the third time this year (2019) that the Council will be burying unclaimed bodies, bringing the total to 68.

Sichimba has since appealed to the members of the public who could be missing their relatives or friends to visit UTH for possible identification of any of the bodies.

Huge Task AHead For Dr Bwalya Ng’andu

$

The decision that President Edgar Lungu made on Sunday was so important such that its announcement couldn’t wait for the morning – it had to be done in the night so that all the Zambians and, of course, the investors know about it. This was the removal of Ms Margaret Mwanakatwe at the helm of the country’s key department – the Ministry of Finance – and the appointment of Dr Bwalya Ng’andu, who was then Bank of Zambia deputy governor, as her replacement.

Dr Ng’andu was sworn in on Monday morning, at which time markets were active and a response to this major change in the Cabinet triggered a movement in Zambia’s dollar denominated government bonds. Like always, the announcement of a new Minister of Finance triggers market movements – either positively or negatively. And for this particular one, the positive showing of the dollar denominated government bonds were a sign that this pick by the Head of State for the finance portfolio has sent a sense of calm among investors. And two days later, a quarterly briefing was held where he spelt out a plan for the country’s economy and promised to ensure implementation of austerity measures in efforts to ‘resuscitate’ the economy.

Why was this so? The Ministry of Finance is a very important ministry, created by the Minister of Finance (Incorporation) Act that allows it to run as a Corporation Sole. This means the Ministry of Finance is a legal entity occupied by a single person (the Finance Minister), who makes critical economic decisions on behalf of the entire country (over 17 million Zambians). This means one who heads this corporation sole can either have positive or negative effect on a country. And right now, what Zambia desperately needs is a positive effect on its economy.

It is undeniable that the country’s economy was almost getting into a comma, while its debt levels kept soaring. This is a fact that President Lungu himself mentioned when swearing in Dr Ng’andu whom he directed, as his first assignment, to stabilize the economy and ensure amortization of the country’s huge debts. This was a huge statement! But obviously, this was not to mean Ms Mwanakatwe, who took over this position from Felix Mutati whom the President had moved to the Ministry of Works and Supply and later fired him. It would be suicidal for any Head of State to watch an economy tumble without taking action to find solutions for it. And the choice for finance minister this time seems to be one that Zambians had long waited for but, of course, it is never too late to try at this stage to reverse what has been lost within a very short time.

The courage to make a tough decision on this matter for the country’s benefit is what will determine the results of the solutions that the new finance minister will spell out and implement to reduce debt and ensure the country’s economy is put back on the rails. Party interests did not matter in this case – Ms Mwanakatwe’s replacement did not have to come from the ruling Patriotic Front! What matters in the end is an individual’s capabilities to discharge the functions of that office to their best ability on behalf of over 17 million people.

State Witness Tells Court Lungu Applied to Have ‘Chagwa’ on NRC

A State witness has told the Lusaka Magistrates Court that President Edgar Lungu added the name Chagwa to his details on his original National Registration card (NRC) bearing the number 216992/67/1.

Agness Musonda, a registrar at the Department of National Registration, Passport and Citizenship, was giving testimony in the case in which Labour Party president Fresher Siwale is facing charges of defamation of the President.

He is alleged to have defamed the President when he stated that President Edgar Lungu’s real name is Jonathan Mutaware and not Edgar Chagwa Lungu.

Musonda testified that NRC number 216992/67/1 was in the name Edgar Lungu and in 1986, there was an application to add a name after which “Chagwa” was added on November 18, 1986.

She further testified that she received a letter from the Inspector General of Police requesting verification of two National Registration Card (NRC) numbers.

She said the first one was 216992/67/1 and the second one was NRC number 652489/11/1

Musonda told magistrate Alice Walusiku that after checking the records, she informed police that the first NRC number was issued to Edgar Lungu born on November 11, 1956, Ndola and that at the time he was getting his NRC, he was residing in Kitwe’s Chimwemwe area.

“I provided this information to the Zambia Police through the office of the Inspector General…on November, 18 1986 Lungu Edgar added Chagwa to the name and the changes were recorded at the back of the records as is the case when someone changes, or loses a card. And as of today, the records show Edgar Chagwa Lungu on NRC number 216992/67/1,” she said.

Siwale is alleged to have, on April 22, 2018, with intent to bring the name of President Edgar Lungu into ridicule, published defamatory matter by word of mouth by saying that the President of the Republic of Zambia had other names, alleging  that Edgar Chagwa Lungu were not his actual names.

Siwale is also accused of having called for the arrest of President Lungu for having three National Registration Cards.

Judge Yangailo Discharges Ex Parte Leave Granted to 2 Fired Sesheke Cops

High Court judge Pixie Yangailo has discharged the ex parte leave she had granted to two Sesheke police officers who wanted to challenge the State’s decision to retire them in national interest.

This follows the State’s objection of the leave on grounds that the applicants did not appeal the decision to retire them to the Police Service Commission.

In her ruling, judge Yangailo agreed with the State’s argument that the matter was not amenable by Judicial Review because it relates to private contractual matters emanating from the contract of employment between the Zambia Police Service Commission and the applicants.

In this matter, Shapa Wakunguma, a senior superintendent officer commanding in Sesheke and Flemming Chilongo, second officer commanding of the same station, had sought leave to commence Judicial Review proceedings in the Lusaka High Court after they were retired in national interest for allegedly beating up PF cadres during the parliamentary by-elections in Sesheke last year.

Cracking the Whip: Lungu’s Cabinet Reshuffle A Sweet Weekend Present

$
0
0

President Edgar Lungu has today made a shakeup to his Cabinet, a long awaited move that has got many Zambians excited, well, for obvious reasons. We actually began this week with a shock reshuffle at the Ministry of Finance which caught the entire nation by surprise. The Sunday reshuffle was announced at night – Margaret Mwanakatwe had been dropped and Dr Bwalya Ng’andu, who was the Bank of Zambia Deputy Governor, was appointed in her place.

In today’s reshuffles, Sports minister Moses Mawere has been fired while higher education minister Professor Nkandu Luo has been moved to Ministry of Livestock and Fisheries.

Transport Minister Dr Brian Mushimba becomes higher education minister while Mawere has been replaced by Ndola Central member of parliament Emmauel Mulenga.

Others are Minister in the office of the Vice President Sylvia Chalikosa who moves to works and supply while housing and infrastructure minister Ronald Chitotela moves to Ministry of Tourism. Vincent Mwale takes over from Chitotela as housing and infrastructure minister while Charles Banda who was at Tourism has moved to Local Government.

Works and supply minister Mutotwe Kafwaya moves to Ministry of Transport and Communication; fisheries and livestock minister Kampamba Mulenga Chewe moves to Ministry of Community Development while Olipa Phiri moves to the office of the Vice President.

In a statement issued by his press aide Isaac Chipampe today, President Edgar Lungu warned that he will not hesitate to kick out any minister who will not improve in their performance of duties. According to President Lungu, he wants to rejuvenate the performance of his ministers because overstaying in one position can ultimately affect their performance. The other key remark made by the President is the fact that some ministers have not been visiting their constituencies regularly to ensure government projects and programmes are implemented and monitored.

In all honesty, if we were to rate President Lungu’s performance this week based on these developments, we would actually give him a score of 9 out of 10. Ending the week on such a note gives the people hope that the Head of State desires the best for them, and that can only happen if his lieutenants, the ministers, perform to the expected levels.

Let us look at the President’s decision to fire the sports minister: Mawere called for this. His people in Chipata Constituency have for a very long time been complaining about how he hardly visits the area to check on them, and of course to see progress made on the many development projects that the government is undertaking. His explanation has always been that he was always busy attending to ministry duties. With the favour done to him by President Lungu, we are certain Mawere will now make his constituency his home, like many other PF members of parliament we know (some of whom have ministerial positions) that are regularly on the ground in their constituencies.

For Prof Luo, her movement from the Ministry of Higher Education was long overdue. She had created an environment where nobody in the sector could advise on how to approach this critical ministry. Prof Luo made a number of decisions that flouted the law while in that ministry. For instance, the suspension or intention to abolish student unions in universities and colleges was against the law. Secondly, her handling of student and lecturer affairs at UNZA and CBU has been one of the worst so far. Actually, her behaviour on some of the decisions made put into question the credentials she holds. Universities are among the most populated constituencies that can either make or break a government and it would have been impetuous for President Lungu to keep someone who was clearly making his government and party unpopular in areas that can give him massive votes at election time.

Let us come to Kampamba Mulenga Chewe. President Lungu has been noticing Kampamba’s dedication to community works in her constituency and other areas that have received support from the government through the Ministry of Livestock and Fisheries where she has been only for a short time. Kampamba is a good organizer; she is a real and strong politician. Community development suits her and we are 100 per cent sure she will fit in very well in this area. She has, in her community, been mobilizing her constituents and supporting them to undertake a variety of income generating activities. She is actually on the ground most of the time and knows her constituency like the back of her palm.

Another noteworthy decision is that of Dr Mushimba’s movement to the Ministry of Higher Education. This man is one of the most sober ministers President Lungu has and on this one, he has made an excellent pick for a higher education portfolio that requires a sober mind to handle lecturers and ‘troublesome’ students. With him in that ministry, there is hope that the CBU will be reopened after a sober discussion is held with the unions and management. He has welcomed this new challenge through a tweet saying “Extremely humbled and privileged to have served at MTC the last three years. I welcome the new challenge as I move to higher education. Among many pressing and immediate interventions, Re-opening CBU is a priority”.

Another minister who has hit the ground running is Vincent Mwale, who has equally tweeted “Ready for the new challenge, low cost housing is my priority”.

Lastly, let us look at the movement of Chitotela from the Ministry of Housing and Infrastructure Development to Tourism. The Pambashe member of parliament had in recent past come under fire from civil society, the opposition and other Zambians after the Anti-Corruption Commission arrested him on a charge of concealing property suspected to be proceeds of crime. They called for his removal or resignation from government, but none of these two happened. He was later acquitted by the court. Chitotela was in charge of a ministry that oversees all infrastructure projects we are seeing in this country – projects worth millions of dollars. His movement from this ministry is a good decision by President Lungu so that he can take a ‘break’ from one controversial ministry after his recent court cases.

A Red Card against the Yellow Card Protest Movement?

$
0
0

The controversial release of the the Financial Intelligence Centre’s 2018 Trends Report has continued to be a subject of debate among our chattering political classes – especially with regard to speed with which it was embraced, adopted, and weaponised as a propaganda lever by opposition figures such as Hakainde Hichilema and Chishimba Kambwili.

Is everything really as clear as it seems, or was there something manufactured and strategically prepared with this sudden ‘leak?’

Probably the most alarming development since the FIC incident has been the emergence of a small but clearly non-organic social media campaign called “Yellow Card Against Corruption” founded by the UPND activist Ms. Laura Miti and the musician Mr. Fumba Chama, alias PilAto, The Yellow Card people not only are aiming to stir up public anger over the FIC report, but they also appear to clearly misunderstand the entire purpose of that institution and the meaning of the Trends Report itself.

First, let us be abundantly clear about this matter: corruption in Zambia is an intolerable scourge. Of course we must stamp out, and indeed, the Trends Report contains a number of allegations that deserve urgent attention.

But here’s the problem with politicisation of leaks like these: those calling for mob justice and breaking down in faux histrionics over their demands for blood are essentially calling upon the Republic of Zambia to abandon the rule of law, due process, and the basic presumption of innocence to jail people just because they say so, not because a court actually found a case to answer.

Now bear with me for a moment, because this is where things get hard, especially for those convinced that the FIC document is some kind of gospel truth.

What if there were a situation in which a corruption allegation did not happen to be true? What if there were individuals motivated, potentially for political reasons, to place false accusations against others in an effort to damage them personally, financially, and politically – with those accusations based on no tangible evidence? Should their targets – on any side of any political partires – not be afforded a defence?

Zambia would be indeed be a very terrifying country if this were the case. I would not say that we are a country without problems – we have many of them. But I would say that comparatively I am proud of our courts system because even under pressure from powerful forces, we can still see justice and rule of law prevail.

That’s why I think we need to all hold up a very strong RED CARD against the Yellow Card movement, because they are attempting to confuse the public with regard to the meaning of the Trends Report.

As the investigative body has done no less than four times before, the FIC distributed its Trends Report to relevant law enforcement agencies at least 80 separate reports that detail an assortment of information and rumours collected about a wide range of possible – but not proven – suspected illicit financial activities.

By comparison, this is nothing close to the Mueller Report in the United States, nor is the FIC even as rigorously detailed as the so-called ‘Steele Dossier’ which detailed so many theories that were eventually proven true about President Donald Trump.

The FIC Trends Report is intended as guidance for the relevant law enforcement agencies to pursue due diligence investigations, to corroborate what may be true and strike off what is disproven. This is part of a little something called due process, that apparently the Yellow Card campaign is firmly against.

The formal purpose of the FIC according to the law that established the entity is to inform the relevant law enforcement and justice institutions of the nation to prosecute suspected crimes and misdeeds. Like the Anti-Corruption Commission (ACC) and the Drug Enforcement Commission (DEC), the Financial Intelligence Centre is a critical instrument of the government’s institutional means of combating illicit activity.

By weaponizing the 2018 report, people like Mr. Hichilema and Mr. Kambwili and their agents on social media are sabotaging not only the integrity of the FIC, but are also encouraging the violation of constitutional rights afforded to persons suspected of criminal activity.

Furthermore, it simply does not seem logical for someone like HH to encourage the abandonment of due process and the presumption and the presumption of innocence – especially for someone who is proven on paper to have founded a joint company with the then-CEO of the Zambia Privatisation Agency at the same time he was employed as a consultant to the agency advising on transactions where he financially benefitted. That alone, for example, is much stronger evidence that anything I’ve read in the FIC report.

So Ms. Miti, Mr. PilAto, Mr. Hichilema, Mr. Kambwili – the law-abiding people of Zambia hereby present you with a RED CARD. Time to leave the pitch and sit this match out.
