FODEP Counsels Kabimba against Abusing Court Process

McDonald_Chipenzi-A leading civil society organization has advised the ruling Patriotic Front not to proceed with their plan to take back the case of the opposition Members of Parliament whose right to re-contest their nullified seats was restored.

Foundation for Democratic Process Executive Director MacDonald Chipenzi said the move by the ruling party was in bad faith and an abuse of the court process.

Chipenzi said the move will further deny the over eight constituencies representation after already going for 13 months without MPs.

“The way things already are they are beyond the 90 days requirement for a by-election to be held once the seat falls vacant. We are wondering why they are pushing that line,” he said.

“The people have been without an area MP for more than one year and you want to further deny them representation.”

He added: “A matter has already been settled by the Supreme Court, why do they want to go to the High Court before the by-election? Why not wait because now it is like a breach of the constitution.”

Last week the Supreme Court ruled that the MPs whose seats were nullified could re-contest their seats as the High Court did not send any reports of criminality to the Electoral Commission of Zambia to commence criminal proceedings.
