Activist Brebner Changala, who has recently been in the news for leading the legal effort to compel the government to disclose the president’s health status, has filed a complaint before the judicial complaints authority against Judge Isaac Tantameni Chubulu Chali.
Changala alleges that Judge Chali displayed an inappropriate and offensive attitude during the proceedings that fails to meet the standards required of judicial office.
According to the complaint, which can be read in full below, Judge Chali attacked the Daily Nation newspaper, which is not party to the dispute, dismissing the publication as “scandal mongering,” while later going on to insult Mr. Changala as a “busy body” with a “misguided or trivial complaint of administrative error.”
“I thusly demand an apology for the sentiments that the judge uttered in his ruling against my person and the same be in writing,” Chanala wrote in his complaint. If Judge Chali fails to apologise, Changala asks that chairperson of the complaints authority “take appropriate action against the judge as this flies in the teeth of misconduct on the part of the judge and an act of intimidation addressed at the litigants who would want matters resolved through our perceived independent judiciary.”
