The wife of deported businessman Abdul Rwigara Simwaya, Miriam has applied for judicial review against the deportation of her husband in the Lusaka High Court.
This follows government’s decision to deport Simwaya last week for allegedly being inimical to the state.
However, Simwaya’s children Mustafa and Asia recently complained against the deportation of their father claiming that it was an abuse of the law.
Miriam is arguing the Minister of Home Affairs abused his office by failing to accord Simwaya the right to be heard or appeal before making the decision. She wants the court to reverse the deportation order.
Government deported Abdul Rwigara Simwaya, a former close partner of late president Levy Mwanawasa to Rwanda last week. Simwaya came to Zambian in 1979 and has been doing business for the past 25 years. Simwaya is a business partner of TAZARA managing director Aka Mbikusita Lewanika and Mbita Chitala.
He has been running a number of businesses including bureau de changes. But the Zambian government accused him of being a terrorist with close links to East Africa Al Shabaab network.
However, Home Affairs Minister, Edgar Lungu, has insisted that Simwaya, 69 was involved in activities that could endanger the security of the country and would not reverse the decision.
