Commentary: Congo election shows flaws in Trump’s Africa strategy

There are good reasons that Joseph Conrad called Congo “The Heart of Darkness” in his vast and utterly disturbing novel of Africa. And most of his reasons have been much on display in the run-up to the country’s long-delayed national elections, set for Dec. 23

Violence in the streets, demonstrations, police shootings of opposition demonstrators and chaos throughout the nation have marred the campaign. Ten days ahead of the scheduled ballot, the national electoral commission announced that 8,000 of the country’s 10,368 voting machines were burned in a warehouse fire of mysterious origin in the capital of Kinshasa. On Thursday, the commission president summoned candidates to a meeting in parliament and said the shortage of ballot papers after the fire made it necessary to hold off on voting until Dec. 30.

There is much at stake in this election, but its outcome seems in little doubt. The Democratic Republic of Congo, a Belgian colony until 1960, has been ruled by the Kabila family for almost 20 years – first by Laurent, who came to power in a coup, and then by his son Joseph. The younger Kabila, elected twice since 2006, is not running again. His power and influence, however, look likely to remain intact.

For decades, Washington has paid little real attention to this nation so critical to Africa’s future. The new U.S. ambassador, Michael Hammer, who arrived in October, is not an Africa expert and his resumé does not mention any service on the continent.

This should hardly be surprising. On Dec. 13, U.S. National Security Adviser John Bolton unveiled the Trump administration’s new Africa strategy, without a single word about Congo. It was all about the United States, focusing largely on the bitter competition with China and Russia for hegemony and how to take them on and win.

The deeper problem of the Trump-Bolton doctrine, however, is its fundamental premise that what’s good for America is good for Africa – in short, what Washington wants, not what Africa needs. “Every decision we make, every policy we pursue, and every dollar of aid we spend will further U.S. priorities,” Bolton began. “All U.S. aid on the continent will advance U.S. interests,” he said. “In Africa, we are already seeing the disturbing effects of China’s quest to obtain more political, economic, and military power.”

Congo, together with its vast problems but even vaster resources, is already a focus of the new East-West war – one that the United States is losing. By its position in the geographic center, Congo is a key beachhead for any assault on Africa. Bordered by nine other nations, its territory – nearly the size of Western Europe – stretches across the continent, spanning two time zones. Its lavish natural resources are the prime reason for major power competition. Indeed, the value of Congo is all but incalculable, and apparently barely appreciated by the United States. Not so for China.

Estimates of Congo’s mineral wealth run to $24 trillion. It sits on nearly half of the world’s reserves of cobalt and vast quantities of high-grade copper ore. A consortium of 35 Chinese companies have joined to begin mining both minerals in multi-billion deals. Yet the country remains one of the poorest in the world.

So, it was hardly surprising that the government welcomed China’s agreement, in return for access to its mineral resources, to build $3 billion worth of roads, hospitals and universities. This money is the root of a problem that’s unlikely to be resolved at Sunday’s polls.

Today’s Congolese politics are a direct outgrowth of the Cold War, when the brutal, corrupt, Mobutu Sese Seko government was supported by the United States as a bulwark against Marxist insurgents led by Laurent Kabila, father of the incumbent. Mobutu was overthrown in 1997; Laurent was assassinated by a teenage bodyguard four years later and Joseph came to power at 29. That was 17 years ago. The nation has barely known a real moment of peace or government honesty since.

Kabila has done little to stop that. With close backing from the military, as Jason Stearns of the non-profit research project Congo Research Group describes it, there’s little incentive for Kabila to end these wars. Under the military’s pay structure, wartime bonuses are the only viable way to earn a living – often a lavish one – in the army. With Kabila and his entourage getting rich, it would be hard to persuade him to relinquish power. Still, to appease outsiders and many of his people, he agreed – after two years of delays – to hold an election.

Moreover, Kabila has agreed to hew at least to the letter of the constitution, with its ban on more than two consecutive terms. But, perhaps taking a leaf from Russia’s Vladimir Putin, who selected his proxy Dmitri Medvedev for a single term, then returned to power, Kabila has tapped the former interior minister, Emmanuel Ramazani Shadary, under sanction by the European Union for alleged human rights abuses, to fill his shoes. That means Kabila can rule from the shadows of his vast estate and private safari park.

At least three major opposition candidates are on the ballot – Martin Fayulu, leader of a coalition of Kabila opponents, Vital Kamerhe, and Felix Tshisekedi, a career politician. An October cell phone poll of 1,179 people in all 26 provinces by a consortium including Stearns’ Congo Research Group shows Shadary trailing the last two. Still, Stearns says he and other observers still expect Shadary to win the single-round, first-past-the-post race.

In the end, the biggest question and the greatest challenge for America and the West is how to bring Congo into the Western sphere of values. Yet, the real poison to the entire system will remain the vast sums of money sloshing through the economy.

Finding a way to gradually channel such resources productively, rather than stumbling blindly into the midst of a superpower battle for supremacy, will be a far better way to advance America’s interests in Congo or Africa as a whole. Otherwise, Washington will certainly be perceived as no better than China, Russia – or, for that matter, Kabila.

Uganda’s president says Miss World Africa should flaunt natural hair

Uganda’s President Yoweri Museveni has criticised the newly crowned Miss World Africa for “wearing Indian hair”.

Tweeting a photo with fellow Ugandan Quinn Abenakyo shortly after her pageant win, he said “we must show African beauty in its natural form”.

Asked what Mr Museveni meant by “Indian hair”, his spokesman Don Wanyama told the BBC: “Just look at the photo and you will see the type of hair.

“It’s an unnatural wig, he was saying she should wear her natural hair.”

Many on social media have defended Miss Abenakyo’s choice to style her hair as she pleases, and have hit back at President Museveni’s comments about “Indian hair”.

Presidential spokesman Mr Wanyama would not be drawn on whether it was a reference to the hair’s texture or its presumed country of origin – India is one of the world’s largest suppliers of human hair for wigs.

Daka, Mwepu Honour Ex-Teammate with Tournament

Chipolopolo stars Enock ‘Computer’ Mwepu and reigning CAF Young Player of the Year Patson Daka have organized a memorial tournament for former teammate at the Zambia U17 level Changwe Kalale in his home town of Kalulushi.

Mwepu and Daka who are on the books of Austrian champions and Europa League campaigners Redbull Salzburg have staged a tournament in honour of Kalale who died last year after having suffered damage to his spine in an accident in 2014.

Kalale was left paralysed by the accident in 2014 and was confined to the wheelchair until his death in December 2017.

The talented teenager was involved in an accident en-route to joining the Chipolopolo camp in December 2014.

He was in the company ex-Zambia defender Nyambe Mulenga and keeper Satchmo Chakawa on a Zesco United bus.

Mwepu and Daka were teammates with Kalale in the junior ranks of the Zambia national team and the duo have opted to honour their colleague.

The tournament is currently underway at Chambishi Rugby Club in Chambishi Township.

NRFA Resolves to Pay Small Scale Contractors by Monday

The over 2000 small scale contractors that stormed the National Roads Fund Agency (NFRA) offices on Thursday have made progress with government agreeing to pay them by Monday next week.

The contractors are demanding for K 200 Million of their 10 months arrears.

On Thursday December 20, the small scale contractors besieged the NRFA offices demanding for their payment.

The group through their representative Isaac Kanyika disclosed that they were owed K200 million with government only paying foreign contractors.

The meeting with the NFRA was rescheduled for December 21 where NFRA and the contractors resolved that payments will be ready by Monday next week.

Small Scale Miners and Medium Contractors president Mutale Mpepo announced after the meeting that all the differences with contractors had been resolved.

“We do not want to be chasing after our payments because a solution has been found, we thank NFRA for honouring our pledge,” has said.

The contractors contended that government earlier  released K148 million through the Ministry of Finance but opted to only pay foreign contractors.

Court Schools Cops on Public Order Act after Acquitting Miti and Others

The Lusaka Magistrate Court set some instructive notes on the Public Order Act as it acquitted Alliance for Community Action Director Laura Miti, opposition PeP president Sean Tembo, singer Fumba Chama, popularly known as Pilato over the $42 million fire tenders saga protest.

Magistrate Mwaka Mikalile gave the police something to think about as they implement the problematic Public Order Act.

In her ruling, Magistrate Mikalile noted that there was no basis upon which the police could stop the demonstration when the organizers had properly notified the law enforcement officers about the protest and they were not a security risk.

She plainly said that the Constitution guarantees the right to assembly for the citizens.

Magistrate Mikalile said that that police should have concerned themselves with the group that went to disrupt the demonstration at parliament buildings and not the peaceful protesters.

She noted that the protesters had followed all the requirements to the letter to hold their peaceful protest.

The Magistrate has since urged the police to act in a professional manner.

“In this circumstances I do hereby dismiss the charge. I accordingly acquit all the accused persons in compliance with the criminal procedure code and set them at liberty forthwith”, she said.

The six accused persons who were facing a charge of disobeying lawful orders have been set free by Principal Resident Magistrate Mwaka Mikalile during her ruling on a case to answer stage.

Meanwhile Miti pledged to keep up her activism even it meant demonstrating again.

“We are very glad that the court has delivered a very pronounced judgment,” she said.

And Tembo said the police should be ashamed of how zealously they wrongly applied the law.

“We believe that this particular matter is a victory, not only to us but all the Zambian citizens who have been denied their Constitutional rights to undertake demonstrations and we are hopeful that going forward the police are going to be ashamed of violating the rights of citizens when they know they don’t have any case in any particular instances,” he said.

And a lawyer for the acquitted group hoped that the ruling had come from a higher court.

“The problem of our police, they think that police stations are their kingdoms that they can do anything in disobedience of the law. They are the same people who make it seem that they act on instructions from the politicians when in most cases the politicians are very innocent,” Mweemba said.

Kang’ombe Explains Kitwe Councillors Land Allocation

In the wake of the outcry over allegations that councillors in Kitwe favoured themselves in land allocation, Kitwe Mayor Christopher Kang’ombe has given insight on the procedure followed.

Kang’ombe has highlighted the guidelines laying the matter that has raised dust to rest.

FULL STATEMENT:

What should be the procedure for allocating land to councillors and those elected?

Currently there is no law which defines a separate procedure for allocating land to an elected person (Councillor, Mayor or MP or Minister).

In the absence of that procedure, these elected officials are expected to apply like any member of the public and their capacity to develop determined by a panel, for the same plots advertised in the public.

Early this year, we did submit to the Ministry of Local Government, a proposal that a circular or statutory instrument be signed to define the procedure for councillor or Mayor to acquire land legally without speculation and to promote transparency. We made this suggestion to avoid any allegations of unfair competition.

As things stand that circular is not yet in place and councillors will have to acquire land through an advert like everyone else who is above the age of 18 years and is a Zambian, whenever land or plots are advertised.

The council can also allocate land through a council resolution to any member of the public including Councillors. This is to encourage transparency and compliance to the current laws of Zambia. By the way, councils are just agents for Ministry of Lands.

Finally, I want to put it on record that a Mayor or a Council chairperson does not sit on the interviewing panel for plots. In Kitwe the panel comprises of one representative from land alliance, an officer from the drug enforcement commission , two councillors and one community representative from the church.

My suggestion is that in future, plots should be allocated on first come first serve basis to avoid any public complaints on who has been allocated.

In addition, may i suggest that a data base of allocatees be done to ensure not the same people acquire land in respective districts.

PF Councillor Suspended for Gate-Crashing Eswatini Trip

A Chililabombwe Patriotic Front councillor has been handed a six-month suspension for forging documents that enabled her illegally travel to Eswatini on a Ministry of Local Government trip.

Kafue Ward councillor Jane Mutwale and council chief committee clerk Sharon Sisya were suspended for six months during a full council meeting.

It has been discovered that Mutwale was not among the designated officials to attend the program but connived with Sisya to forge documentation authorizing her to travel,

“The Council held a special Council meeting on Monday in which it decided that the Councillor be suspended for six months but for the Chief Committee Clerk her case has been forwarded to the Ministry of Local Government for guidance,” a source disclosed.

“Well it was only discovered that the two people forged and altered documents from Cabinet Office to allow them to travel, for now Ms Sisya has been given a summary dismissal but her case has been taken to the Ministry for further guidance.”

The duo’s act cost the government K97, 000 more in expenditure for the trip.

Lundazi Cut Off from the Rest of Eastern Province

Lundazi District of Eastern Province has been cut-off from Chipata after Msuzi Bridge was washed away by heavy rains.

Msuzi Bridge which connects Lundazi and Chipata was washed away on Friday night following a heavy downpour.

Eastern Province Minister Makebi Zulu says Road Development Agency (RDA) engineers have been sent to the area to assess the situation.

NCP Presidents Demands Bars to Open at 18:00 Hours

New Congress Party president Peter Chanda says government should impose compel bars to open at 18:00 hours instead of 10:00 hours.

Chanda has also suggested that the legal drinking age should be raised from 18 to 21 years old.

Addressing a media briefing in Lusaka, Pastor Chanda said embrace former Gender Minister Victoria Kalima’s suggestion that the minimum age for drinking should be upped from 18 to 21 years.

Chanda said it was wrong for bars in the country top open at 10:00 hours and suggested that the opening time be moved to 18:00 hours.

“When are we going to have people think of being productive? The laws are there, bars are not supposed to open at 10 hours. It is only in hotels where it is allowed, bars should open at 18 hours,” he said.

Chanda has urged the council to toughen its implemntaion of bar opening hours and under-age drinking.

He said that Zambians should desist from embracing the culture of drinking beer in the morning till the following day.

“The local authorities must employ more officers to build capacity to see to it that the under-age citizens do not patronise bars that is why it is wise to adjust underage drinking threshold to 21 years” Chanda said.

He said his party will make the youth more productive than spending time drinking beer.

Chanda said his party sought a more accommodating world for women.

“As NCP we are preparing people for economic progress, we will create stability and employment. If you are a woman out there, you are not a sexual object but an equal partner in development and progress,” he said.

Zesco Booted Out of Champions League

Zambian champions Zesco United has been booted out of the CAF Champions League by giants TP Mazembe after the two sides drew 1-1 at Levy Mwanawasa Stadium this afternoon.

TP Mazembe did the hard work at home where the won 1-0 and added an away goal today to claim their place among Africa’s finest sides with the aggregate score being 2-1 in favour of the visitors.

Lazarous Kambole had given Zesco United a false start with a predatory strike in the box on 12 minutes but the experienced Tresor Mputu cancelled out the goal with a fine header in the 48th minute.

Mputu benefitted from some suspect defending from Mwila Phiri under whose watch the goal was scored.

TP Mazembe started with two Zambian players in the first eleven in 2012 Africa Cup winner Nathan Sinkala and Kabaso Chongo.

Skipper Rainford Kalaba was a late second half substitute to give him a triumphant return to his former club Zesco United.

Zesco United will now be relegated to the CAF Confederation Cup.

Green Eagles is in action in the Confederation Cup later today against Algerian side Hussein Dey FC.

The two sides drew 0-0 in the first leg.

On Sunday Nkana will be away to Simba SC in Tanzania while Green Buffaloes host Sfaxien who butchered them 4-1 in the first leg.

Nkana won the home match 2-1 and will be hoping to finish off the job away in Tanzania.

Presidential Aide Tells Opposition to Move on After ConCourt Ruling

Presidential spokesperson Amos Chanda has advised the consortium of opposition political parties to come to terms with the Constitutional Court ruling that President Edgar Lungu is eligible to contest the 2021 elections.

Chanda said it was undemocratic for the consortium of opposition political parties to attempt to protest the decision of the Constitutional Court as it was final.

He advised them to not only accept decisions that were in their favour but also do the same for unfavourable decisions.

“…to attempt and disrupt this constitutional order is undemocratic which is what the President regrets in the actions of the opposition that when you go to court and a decision is dispensed you must move on go to the next election,” he said.

Chanda said the ruling by the Constitutional Court had breathed certainty into Zambia’s political life.

He said that it was now easy for investors to do business under calmer waters in the absence of political uncertainty.

“There has never been this certainty in the history of our country since 2001, that there is a guaranteed full term for the winners to govern,” he said.

“This is the only time when that situation has allowed, because there a President elected under the majoritarian system of 50% plus one threshold and there is also a running mate in the event that the President does not continue for any reason.”

 

Chanda added: “There is a certainty of tenure that one government, that one party that has been given the mandate will fulfil and see off the mandate for five years.”

A consortium of opposition political parties in concert with the UPND held a press briefing where they announced that they will hold demonstrations against President Lungu’s confirmed eligibility for the 2021 elections.

The Constitutional Court ruled that although President Lungu had contested elections twice including a by-election after President Michael Sata died, he was still eligible to contest in 2021 as his first election did not cover a more than three year period.

Zambian MPs Woo Indian Tourists

New Delhi: GOVERNMENT Parliamentary Chief Whip STEVEN CHUNGU has called for sustained effort to boost Zambia’s tourism.

And United Party for National Development – UPND LUFWANYAMA Member of Parliament LEONARD FUNGULWE says Zambia has a competitive advantage because it is rich in nature tourism.

This came to light when the law makers visited the TAJ MAHAL in AGRA, India, where CHILANGA Member of Parliament Parliament MARIA LANGA called on Indian tourists to think of visiting Zambia.

The three legislators are part of a delegation led by Speaker of the National Assembly PATRICK MATIBINI who held meetings with the Vice President of India VENKAIAH NAIDU and Speaker of the LOK SABHA (Lower House) SUMITRA MAHAJAN in New Delhi, accompanied by Zambia’s High Commissioner to India JUDITH KAPIJIMPANGA.

In an interview with India’s Parliament Television, Speaker of the National Assembly PATRICK MATIBINI says the  decision by the President of India, SHRI RAM NATH KOVIND, to visit one of the seven natural wonders of the world, the VICTORIA Falls, in Livingstone during his three day State Visit to Zambia early this year, should encourage more Indian tourists to visit Zambia.

Justice MATIBINI says the VICTORIA Falls allows tourists to carry out bungee jumping while others dive on the natural swimming pool fondly known as the DEVIL’S Pool.

He says Zambia has key assets such as pristine national parks and game management areas, which are home to a great diversity of wildlife and flora and fauna.

Dr. MATIBINI has noted that Zambia is a birthplace of the legendary walking safari, untamed, and has an adventure that is a perfect match for its wonders.

According to recent statistics revealed by India’s Union Minister of State for Tourism (Independent Charge) ALPHONS KANNANTHANAM, eighty-two million people are currently employed in the tourism sector in his Country and India is expected to be generating FIFTY Billion US Dollars in 5 years.

Trade Kings Washes Away Malambo Water Blues

As a Member Parliament for Malambo, I would like to thank the Trade Kings Group in Zambia for sinking 10 boreholes out of the 20 boreholes they pledged as a social corporate responsibility to my people in the constituency.

The sinking of the boreholes in ten communities will alleviate water crisis in the constituency.

The boreholes will ease the burden placed on the communities because it is the number one problem in remote areas across Mambwe and Zambia as a whole.

Water situation in the province is very bad and giving the community access to clean and safe drinking water is great social corporate responsibility by the Trade Kings Group that impact positively on the lives of the people.

Disaster Strikes in Kasenengwa as 3 Bridges are Washed Away

Disaster has struck in Kasenengwa Constituency with three temporal bridges washed away.

A heavy downpour has left most parts of Eastern Province cut off from the Chipata.

The bridges that were built by local communities are Katondo, Kasenengwa and Chiwayu.

With the bridges washed away the Kasenengwa constituents are cut-off   completely from Chipata and Mambwe districts.

Area Member of Parliament Sensio Banda had a check on the site and had an appreciation of the situation.

The Chipata-Msoro road is a strategic road which passes through Kasenengwa Constituency linking Chipata and Mambwe districts.

Banda said he would engage the Disaster Management and Mitigation Unit.

Social Cash Transfer beneficiary drowns after drinking spree

A 68-year-old man of Chief Kapichila’s area in Lundazi district in Eastern Province has drowned in Kakumba stream.

Jastone Phiri of Kajowola Village who was coming from a drinking spree met his fate on Friday between 17:00hrs to 18:00 hrs when he attempted to cross the flooded Kakumba stream on his way home.

Msuzi Ward Councilor, Daudi Phiri who is also the son to the deceased has confirmed the incident in Lundazi.

Mr. Phiri disclosed that on the fateful day, the deceased who was one of the beneficiaries of Social Cash Transfer (SCT) program had gone to Kakumba pay point to get his money and was later seen drinking at a named bar within Kakumba Trading Centre before he met his fate.

He said his body was found yesterday morning floating in an upside position in Kakumba stream, adding that the deceased he has left behind 10 children.

The civic leader further said the body of the deceased is lying in Lundazi District Hospital Mortuary awaiting burial.

Meanwhile, efforts to get a comment from Eastern Province Deputy Commissioner of Police, Sharon Zulu proved futile as her phone went an answered.

Suspect Commits Suicide at Matero Police Station

LUSAKA, 24TH DECEMBER, 2018 – Matero Police recorded a case of suicide which occurred at Matero Police Station in which Elvin Miyanda Mwanza aged 42 of Maloni Compound in Lusaka West committed suicide. The deceased was reported to have assaulted his 37 year old wife and a report was made at Matero Police Station.

The suspect who is now deceased was apprehended from Lusaka’s Avondale by officers from Simon Mwansa Kapwepwe Police Station and was transferred to Matero Police where the report was made. After disembarking from a Police motor vehicle, the suspect threw himself in front of a rear tyre of a Volvo truck registration number AJE 2866 which was pulling out of Matero Police Station being driven by  Chansa Kalutwa aged 29 years. He sustained injuries on the head. The body was taken to UTH mortuary and postmortem has been conducted today.

An inquiry file has been opened and statements have been recorded from the wife of the deceased who was present at the time the incident happened, also from the driver of the truck, officers and other independent witnesses who were present.

ON GOVERNMENT ABOLISHING MEAL ALLOWANCES

The Zambia National Students Union (ZANASU) has noted the growing anxiety among students from  Copperbelt University and University of Zambia on the news reported in today’s edition of News Diggers about Government abolishing meal allowances. We call for calm among students as ZANASU and various student unions have opened a fruitful dialogue with the Higher Education Loans and Scholarship Board (HELSB) over student loans and grants.

While we do not doubt the thoroughness of our media colleagues in doing in conducting responsible journalism, ZANASU cannot confirm the authenticity of the news attributed to Minister of Higher Education, Honourable Professor Nkandu Luo. We are not aware of any regulations or statutory instrument that could have been issued to abolish the provision of meal allowances. The fact that no regulation or statutory instrument has been issued on the abolishment of meal allowances, as yet, the report must not raise any unnecessary anxiety among students.

We also believe delays by government to meet its obligations in paying allowances which are part of the students’ loan and grant agreement must not become an excuse for students to cause unrest or damage to public property in and outside institutions of higher learning. Students must always prioritise the pursuit of dialogue with authorities before anything else.

ZANASU remains committed to engaging with Government, through the Head of State, Ministry of Higher Education and other relevant authorities to resolve matters affecting students and we encourage students to get updates from their Union representative, where such Unions exist. The dialogue which President Lungu had asked HELSB and students to engage in has commenced and students will be updated on progress.

Once again, we want to assure government that students appreciate the funding government provides to students in form of grants and loans, but government must always seek to pursue dialogue on any proposed changes in the grants and loan structure to avoid being misunderstood

Grade 7 Results Post 100% Countrywide Pass Rate

All the 388,331 candidates who sat for the grade seven composite examinations have been selected to grade 8, bringing the national progression rate to 100 percent from 99.14 recorded in 2017.

 

Ministry of General Education David Mabumba has however revealed that out of 388,442 candidates that sat for the 2018 grade seven examination, 239,024 candidates obtained divisions, 1, 2 and 3 representing 61.53 of the total candidates that sat the examination.

 

Speaking during a media briefing in Lusaka today, Mr. Mabumba adds that a total of 149,307 candidates obtained divisions 4.

 

Mr. Mabumba explained that a further analysis of the results along the lines of gender revealed that boys performed better than girls in all subjects except the English Language.

 

Meanwhile Mr. Mabumba is concerned with the 55,258 candidates who were absent from examination.

 

The Minister has reiterated that in 2019 the Ministry will focus on implementing reforms in order to address challenges facing the education sector.

Libala High Pupils Fined K5, 000 for Examination Leakages

Six grade 12 Libala High School pupils who were caught with examination leakages have been handed K5, 000 fines each by the Lusaka Magistrate Court.

Magistrate Humphrey Chulu found all the six guilty and sentenced them to 18 month imprisonment or pay K5, 000.

In default of the fine, the pupils will serve an 18-months jail term.

In this case, the pupils aged between 17 and 20 years pleaded guilty to unlawful possession of examination papers or information.

On November 2, this year, the six, without lawful excuse had in their possession Grade 12 examination question papers.

The matter came up for facts and sentencing befor Chitalu.

Facts are that on November 2 this year around 09:00hours, a detective received a phone call in which the informer reported that some pupils at Libala Secondary School had pre-written mathematics paper one examination.

Acting on the report, the officer went to the school with an examinations officer.

The officers were ushered into the Head Teacher’s office where the suspects were and were found in possession of the examination papers.

Police apprehended the suspects and took them to Long acres police station where they were interviewed and admitted to the charge.

In mitigation, the juveniles, through a social welfare officer asked for court’s leniency as they were first offenders.

Magistrate Chitalu then fined the juveniles K5,000 each which should be paid by December 31 this year.

44 UPND MPs Await ConCourt Decision on Presidential Boycott

A Kabangwe resident who applied to have 53 opposition UPND Members of Parliament’s seats to be declared vacant for shunning President Edgar Lungu’s address on March 17, 2017 has kept his fight going in the Constitutional Court.

Richard Mumba has asked the Constitutional Court to grant him an Order for leave to amend the process.

According to an affidavit in support of summons for leave to amend the process pursuant to Order IX Rule 19 of the Constitutional Court Rules, the petitioner is desirous to amend the process by adding Articles 9 (2) which were left out in the originating process.

Mumba wants the Constitutional Court to declare the seats for the lawmakers vacant for having breached their constitutional duty of swearing loyalty to the President.

In this case Mumba petitioned the Constitutional Court seeking a declaration that the seats of 53 UPND MP’s among them Mazabuka MP Garry Nkombo be declared vacant for boycotting the state of the nation address to the National Assembly by the President.

The UPND lawmakers boycotted the Presidential address following their post 2016 election grievances where they alleged that they did not recognize President Lungu.

Nine of the 53 lawmakers were later removed from the list by Speaker of the National Assembly as they had permission to be away from parliament.

The MP’s that were left off the hook were Jack Mwimbu, Mwandi (Monze Central) Sililo Mutaba, Elliot Kamondo (Mufumbwe) , Ephraim Belemu (Mbabala), Victor Lumayi (Chavuma) among others.

The remaining 44 lawmakers were suspended from parliament for one months with their pay also taken off for that period.

The 30 days suspension meant they were not be allowed to enter the precincts of the National Assembly, including the Motel and not participate in any business or activity of the House or committee they were assigned to.

Dr Matibini cited the powers vested in him under section 28(2) of the National Assembly (Powers and Privileges Act).

However, Mumba additionally sought a stiffer punishment by petitioning the Constitutional Court to declare the seats vacant.

The matter is before Justice Enock Mulembe who has since adjourned it to January 15 ,2019 for hearing of an application for an order for leave to amend process on behalf of the applicant on the grounds set out in the affidavit in support.
