The Lusaka Magistrate has referred the case in which fourth Republican president Rupiah Banda is facing charges of concealing gratification to the High Court citing constitutional issues.
A jovial looking Banda, who appeared before Magistrate Obbister Musukwa, told journalists afterwards that the courts had become his new worship centre.
He is alleged to have concealed gratification from two Chinese firms between January 1, 2011 and August 30 the same year.
In his application President Banda has asked whether DPP Mutembo Nchito should prosecute the matter as he is not impartial.
DPP told the parliamentary select committee that he would declare interest in any cases involving RB.
Nchito is expected to respond to the matters by the defence counsel by April, 24, 2014.
Banda is accused of concealing gratification of 10 trucks valued at US$180, 000.
Addressing MMD cadres outside the court Banda said the court had become his second home and said the MMD was not going to die.
